Hi,

Can anyone offer any advice on the lastest clamp down on ex pats in Spain?
Basically anyone who is living in Spain and has assests outside the country MUST declare them by law! By assets I mean property, bank accounts, savings, ISA's, shares, businesses, etc. At the moment pension plans are not included. This probabaly only apllies to people who are autonomos and 'in the system' but more and more information is been shared between counrties and the tax man is hungry!
If you choose not to declare your assets through the modelo 720 form and you are found to have assets outside of Spain then HEAVY fine may be imposed and taxes upto 150% of the value of the asset.
I have been advised by my accountant to declare everything as they will discover eberything in time.
Has anyone else heard of this recent development and what advice can you offer?

Having just had dinner with a Spanish friend he seems to think that this is only an opportunity to admit to 'black money' purchases before a deadline.  (A bit like America had regarding Swiss bank accounts.)  In other words if your foreign assets are legitimate then there is nothing to declare but expect punitive treatment if they find stuff which you haven't confessed to which is hookie.  Expect the Spanish Inquisition!!! 
PS  Last I heard there were no forms available to fill in.  Perhaps they need to pay the printer in cash to get on with them.   ;)

This is nothing new really, and a no brainer... if you pay your taxes in your nominated eu country you really have nothing to worry about , its the people who hide their assets and dont make a contribution to the society they live in who have everything to be worried about, and rightly so, they are as bad as benefit scroungers....!

Has anyone got any updates or clearer information about this . Is it compulsory ? What happens if you do not fill the form in but any assets abroad ( UK ) are legit and taxed at scource ?. Is the form available in english ? Do you only declare if your income is over a certain amount . I understand there is a time limit ...April I think . If it is compulsory who are the best people to contact to get it sorted ? :-/

Yes it's compulsory.
Hefty fines,  if you are found out to have ANY assets, other than here in Spain, worth over 50.000 euros. and havn't filled in the form.
So it means, bank accounts, shares, property etc. over the value of 50.000. This is per item.
This is not to do with paying taxes, in either country.
I believe you can find the form on on line now, but not in English!

Hi Rita, it could well be "to do with paying taxes in either country." If you have assets from which you have derived or are/will derive an income you could depending on your past, current or future residence and tax reporting be liable for tax payments as a result of information derived from the registration of assets. However you have to make the registration.
Its a very complex area.  :)

All sorted through Carlos (see above)  :)
Not too painful, worth doing for peace of mind.

As Rita said this is not dependant on your tax declaration.
It needs doing, or they can take up to 150% in fines - Ouch!

Not had the final bill yet, but it is supposed to be about €30.
Cheaper than a tax Renta and easier.

Cost is 30 euros per person, plus I.V.A.

Carlos is not a solicitor.
We use Ton Batlle, who is based in Tarragona.
Really nice, reasonable and English speaking.
He sometimes comes out to Tortosa, so worth making a phone call to him.

We can also recommend Ton Batlle, the Solicitor.

He has worked for many of our clients who buy property. He is very efficient and professional, and our clients are always happy with him.

He also comes out to Caspe to the Notary there as well.

I would not concur 100%.  After eight years of us buying our property we are still having problems with BASE due to it not being properly registered in the first place.  He claims that it not his responsibility ?

It seems that here in Spain, the solicitor's job is to check out that the property is legal etc.
It's the estate agent who usually goes with you to Base, to register the property into your name, after buying it.

For a Solicitor I would heartily recommend David Pique in Miami Platja. He speaks excellent English, has a great rapport with the Notary in Miami and will go out of his way to help you. His phone number is 615 694 576.

Hi Rita.  I hear what you say and that is more or less what happened.  Trouble is, the ref numbers were wrong when it was bought by the previous owner and still not been corrected when we bought it.
"legal etc".  I would have assumed that that includes the details held at Cadastral were correct as well ?
I know this isn't UK, but for a similar fee, conveyancing solicitors can be trusted to make sure that everything is in order, as far as I know, including land registry.

We agree with Bigyin about Ton - he was very expensive because we were told that he also provided long term support but this has not been the case. We requested a copy of the architect's report which did not arrive and when asked for another copy to be sent were told it would cost another 300 euros. He has not responded to a number of emails and requests. We were given conflicting information by him about the necessity of recording the age of the properties we purchased. Can recommend Gaspar at pedrocarpena@notariado.org in Tortosa. He is Spanish but speaks good English and is very helpful. Also for declaration of assets we also second Rita's recommendation of Carlos - very helpful and will also deal with tax returns.

Tax declaration deadline 30th June

Yes David those dates are correct.
As I stated previously, assets deadline is 30th APRIL.
I wanted to point this out, as there will big fines.

This is different to the yearly taxes.
