Of course an NIE is not the same as the residency. The problem is that the police have issued fines on the basis that NIE is evidence of residency, which is not correct as in the cases above. Sam lives in the Uk why should it be necessary for him to have a Spanish licence.? or face a fine.? One cannot get a Spanish licence using a NIE cert.
