Arbeola i Rigau, Generalitat de Catalunya’s Head of the department for housing and the environment for the province of Tarragona. In that meeting we raised our concerns for the impact law 18/2007 (DOGC 5044) is having on British Nationals who in the absence of a “cedula de habitabilidad” are now unable to sell their properties. Mr Arbeola promised to inform the Catalan minister for Housing and environment of the situation. Since then, we have been in contact with the Generalitat de Catalunya and we are in the process of arranging a meeting with the Mr Baltassar, Catalan minister for housing and the environment. When this meeting takes place we will ask the minister for what advice should be given to British nationals who are no longer able to sell their properties. I will be in contact with you once the meeting has taken place to update you on the latest advice from the Generalitat. In the meantime, we would advice you to seek legal advice."


Just to follow up on the above Mark Smithson has been in contact to say they are having a meeting with 'Generalitat officials' on July 27th.

The latest information coming out of habitatge isn't good and looks at the moment like only properties that were on the land registry BEFORE 1984 will be issued with cedula's.  This is a tiny fraction of rural houses.  Debbie from the Olive Press has also let me know that she has been advised by a Spanish solicitor that the situation is getting worse as cedula's issued on rural properties within the past 4 years are now being reviewed and may be cancelled.

It's therefore really important that as many people as possible email Mark to express their concern and anger about the cedula situation BEFORE this meeting takes place.  It may be the only chance we get to get something done and to get across the scale of the problem.

Hi everyone, I just wanted to let everyone know my experience re obtaining a Cedula. We found a paragraph in our escritura which said that our house had special permissions to be built. Our house is in the campo . We then went to the town hall to ask if this was true, they said it was and gave us the building certificate.
We then took the certificate to the habitage office in Tortosa and asked if we could get a cedula for our property. we were told yes , but we still needed to get a couple more things.
this we did and  presented it to the habitage office, 4 weeks later we now have our Cedula.
My advice is if you need to clarify if you can get a cedula go directly to the habitage office in Tortosa and ask their advice, they were extremly helpful and advised us every step of the way.
When we purchased our house I wasn't aware of the fact that we had a building license, we didn't have a copy of the original cetificate, it was just by pure luck that we read the escritura and noticed this short paragraph, which stated the number of the building certificate.
Our house was only built in 2001, so without the license there would be no way we could have got a Cedula.
So everyone look through your escritura's to see if there is a little paragraph there to tell you that you have a building license

hi everyone, i dont know anything about cedulas ,i am more concerned about all the people around ginestar that have been sold plots and told it was ok to build ,and then live in their houses on their plot,they are the ones that need the attention to resolve the issues, and why they were told all would be ok,when obviously it is now not ok, Angry  ,
what about them and all the other people in the villages around about,they are the ones that also need a help from a higher power to resolve their issues,and also get their money back if they arent going to be able to use their properties Angry does anybody think these issues will be resolved ,i dont think so ! the situation for all these people must also be a nightmare. there are certain people that have made a lot of money in these areas and now couldnt care less about what happens to all the honest genuine trusting  people now lumbered with illegal properties. Sad

well if we don't get our cedillas and all the other problems solved then  WE SHOULD ALL DO A PROTEST MARCH to show we are not putting up with all this sh..t after all we have all bought a lot off well earned money to spain our life saveing ,we have 3 propertys and one plot so have a lot more than some to loose and i tell you this we are not giveing in without  fighting for what needs to be sorted (and sorted now not in years to come )the government needs to get there fingers out off there A.. so we can all get on with what we came here for A STRESS FREE  LIFE

Totally agree Nen we only came here for a stress free existence but as we have all found out Spain and Catalunya are about to get ya and we are not being paranoid they really do want to piss us all off and hope we leave!!

yes my friend Smileysome people  will give them what they wont and leave if they can get the paper work they need to sell.we didn't wont to leave BUT ALL THIS GOALPOST MOVEING IS DOING MY HEAD IN at least in the uk you new were you stood with things even the people who should know here don't so how are we supposed to Undecided

I'm going to try to get a Cedula for my house and will report on here how it goes.  I've started today (16/7/10).

Step 1: I went to BASE and got a copy of my IBI (which has all the details about values, calssification etc.)
Step 2: I took this, plus my Escritura to Habitatge to ask what I needed to do for a Cedula.  They looked through the escritura and the IBI and told me I had to go to the Ajuntament to request a certificate from them.  They have now sent out guidance to most Ajuntaments. A copy of the document is below.
Step3: I went to the Ajuntament with my escritura and asked for a certificate. They filled out a form, took a photocopy of my escritura, and said it would be ready sometime in August.

Points:
1. In my escritura it is written: una CASA destinada vivienda unifamiliar aislada.
2. The year of construction is 1987
3. The 'Uso local principal' is Residencial (this is from the Catastral)
4. The 'Clase' of the 'Localizacion' is Urbano (again from the Catastral)
5. The 'Tipo finca' is Parcela con un unico inmueble (again from Catastral)

Our Casa is noted as being built in 1970 which helps !!

WELL OUR 2ND HOUSE COMES UP OK TO  Smileyit stats class urban/use residential built 2005 property type a single building plot constructed area 101m2 and our 3rd one comes up as class rustic/use agrarian so the house is not registered YET LOL Undecided

someone asked me how  THE LINK nigel put up works .

you click on the link
put in your cadastral referance
location i.e tarragona
village name /under that were in the village u live (address)
parcela number and poligona number
then click on
datos y consula description y graficie
if you filled it in ok your details will come up in a reference number the item
you cick on the reference number and it will give you the details of your property
if you have a translator on you comp u can print it off in spanish and english
we have done both and are keeping the print offs with our deeds for reference

well we went to our town hall today asked for a form for the cedula and they through their hands in the air and said NO we said we needed one as we wonted to sell our property they said if you brought it without one you can sell it without one we said no you cannot.after about half an hour of trying to find out why we cant get one we left empty handed  Cryso now we are going to take all our paperwork to the notaria to see what they say this is for the legal house built in1975 (what a nightmare) this house supposed to be the easy one to sort out and  we are getting no were and we have two more houses to sort yet  Angry as anyone other than nigel and ourselves tryed to get a cedula if so how did you get on?
